Nearly 70 House Republicans are against the Biden administration’s recent changes to Title IX. In addition to sex-based discrimination, the changes will also ban discrimination based on sexual orientation and gender identity. Several lawmakers, led by Rep. Mary Miller (R-Ill), created a bill to reverse the new Department of Education policy.
“No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.” – Title IX of the Education Amendments Act of 1972 (2018)
Miller has criticized the administration’s changes, arguing that they undo the progress women have worked hard for under Title IX over the past fifty years. “For more than half a century, Title IX has protected women and girls, ensuring they have equal opportunities in education,” she claimed.
One of Miller’s main concerns is that the changes could lead to transgender women using facilities aligning with their gender identity, rather than biological sex, which could put women’s safety and privacy at risk.
The bill has gained the support of many well-respected Republicans, including House Education and Workforce Committee Chairwoman Virginia Foxx (R-NC) and House GOP Conference Chairwoman Elise Stefanik (R-NY). Concerned citizens have also protested that this change could harm and take away the rights of women and girls across the country, especially when it comes to sports.

Supporters of the reform continue to argue that the change is essential for protecting the rights of transgender students, no matter the cost.The new rule will be in effect from August 1, just in time for the new school year.
